"WIN A SONY BRAVIA LCD" PROMOTION
- Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Victorian, South Australian, Queensland and New South Wales residents aged 18 years or over who are existing or new Origin Energy customers, including Origin Energy LPG customers (“Eligible Entrant”).
- Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
To enter, Eligible Entrants must have entered into direct debit payment arrangements in respect of their Origin Energy gas account, and/or electricity account. This payment arrangement must be in operation at the date of the prize draw.
Eligible Entrants will automatically be entered into the competition for the draw. - Only one entry per Origin gas or electricity account will be accepted.
- Promotion commences midday AEST on 1st November 2008, and final entries close at midday AEDST on 15th March 2009. The draw will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne Vic 3004 at midday on 6th April 2009
- The winner will be notified by telephone, and confirmed in writing, and the winner’s name will be published in The Australian on the 20th April 2009.
- The first valid Eligible Entrant drawn will win a Sony 40 inch X Series Full High Definition BRAVIA Liquid Crystal Display Television (model number KDL40X3100) valued $2,559.00 (Including GST) (RRP).

We will offset the number of tonnes of greenhouse gas emissions which we estimate to be produced solely from electricity used to operate a Sony 40 inch X Series Full High definition BRAVIA LCD Television (model number KDL40X3100) for 5,000 hours based on estimated electricity consumption of 1,300kWh during the first year of operation. We will do so by arranging for the surrender of equivalent amounts of emissions reductions under Origin's Carbon Reduction Scheme™, up to a total retail value of $65 (including GST) at the time of surrender. Power consumption information is published on Sony’s website at [website]. Greenhouse gas emissions have been estimated by applying the applicable Australian Government emission co-efficients current at the date the emissions reductions are surrendered. Estimates of consumption and tonnes of emissions do not represent actual usage of the prize by the winner or the corresponding emissions. Total prize valued at up to $2,664.
- The Promoter reserves the right, at any time, to request the Eligible Entrants and/or the winner to provide evidence to verify the validity of entries and Eligible Entrants (including proof of identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or tampers with the entry process. Identification considered suitable for verification is at the discretion of the Promoter. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights.
- If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
- The Promoter’s decision is final and no correspondence will be entered into.
- All winners will be contacted via telephone to arrange delivery of their prize.
- If the prize is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
- The prize, or any unused portion of a prize, is not transferable or exchangeable and cannot be taken as cash. For the sake of clarity, the prize is distributed on the condition that it not be resold or offered for resale at a premium or be used for advertising, promotions, competitions or other commercial purposes without the Promoter’ prior written authorisation.
- Subject to the unclaimed prize draw, if for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize may be forfeited.
- A draw for the prize, if unclaimed, may take place at midday AEDST on the 6th July 2009 at the same time and place as the original draw. The winner will be published in The Australian on 27th July 2009.
- Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
- Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of the prize.
- As a condition of accepting any prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
- The Promoter collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Eligible Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
